As an employer or boss, keep a record of your experiences with this employee. Fired employees will often tell you "secrets" about your work environment that a resigning employee never gives. As long as the poor performance or behavior occurs within a reasonable period, like 6 months, you give him another Final Written notice. Even worse, as your other employees notice the bad worker is "getting away" with not doing what he or she is told, they will begin to show signs of misbehavior and disrespect as well. Even when the jobholder is in trouble, you're willing to invest in his success. Don't get emotionally involved and do not levy blame. Typically coworkers don't expect much from these workers and everyone is demoralized because of it. And, a paid suspension sends a bad message to the insubordinate employee who's getting a paid vacation. As soon as you make the rehire offer, this caps the employee's damages. A good dismissal package allows that worker to tell others what the company "did for me" instead of what it "did to me.". Likely for your first separation, it's a day's worth of work.
