A fair inquest means you get the employee's side of the story, talk to other witnesses and gather physical proof (if any) in a proper way. If you're sure that this individual is creating a poor work environment or detracting from the goals of your business, then you shouldn't hesitate to let him go. After you have given her 3 warnings for her bad disposition, you can lay off her. Terminating a jobholder is a delicate task and your letter is an essential part of that difficult procedure. Juries think it's insensitive and outrageous to sack someone during this time. This obviously tells the jobholder that if their productivity does not significantly improve within 30 days, they will face dismissal.
